CALIFORNIA LEGISLATURE POISED TO PUT MEN IN WOMEN’S PRISONS UNDER SB 132

Dear Senator Wiener:

Your proposed bill, SB 132, would harm one of the most vulnerable groups in society: incarcerated women. It would allow any male at any time to self-declare that he has a woman "gender identity," and on that basis allow him to demand to be housed in a women’s correctional facility. It would forbid prison officials from taking into account material factors that put women at greater risk of harm when incarcerated with men, including anatomy, the presence or absence of a diagnosis of gender dysphoria, and the presence or absence of any other physical or mental health diagnosis.

If adopted, SB 132 will put women prisoners and women prison guards and staff, at serious increased risk of male violence.

These harms have received no consideration in the legislative materials offered in support of SB 132.

For these reasons, we urge you to withdraw SB 132.

BACKGROUND

Led by state Senator Scott Wiener, the California legislature is, once again, planning to harm women and girls in order to serve the demands of “gender identity” activists. This time Mr. Wiener is targeting some of the most vulnerable individuals in society: incarcerated women. We need your help to fight SB 132. Please see the “take action” links below.  We currently expect all senators to vote whether to pass the bill on or before May 31.

SB 132 would:

  • Allow males at any time to self-declare their "gender identity" and preferred first name, gender pronoun, and honorific.
  • Allow males at any time to be housed at a correctional facility designated for women unless the incarcerated individual's "perception of their own health and safety needs requires a different placement."
  • Force facility staff to use language pretending that men who claim to have a woman "gender identity" actually are women.
  • Forbid facility officials from considering anatomy, the presence or absence of a diagnosis of gender dysphoria, and the presence or absence of any other physical or mental health diagnosis.
  • Forbid prison officials from overriding a prisoner's chosen preference to be housed in a women's facility unless they demonstrate in advance "significant security or management concerns."

SB 132 is a stunning act of female erasure and elevation of men's feelings over women's physical and psychological safety. It ignores the fundamental reasons that facilities for incarcerated individuals exist in the first place: whether for biological or social reasons, men are far more likely to sexually assault or rape women and to engage in other forms of violence and voyeurism. Further, women are the only sex capable of being involuntarily impregnated.

The statistics cited in support of the bill all involve violence against incarcerated males and mention only incarcerated “trans women.” The bill’s sponsors offer no data, information, or discussion about the vulnerability of incarcerated females to violent assault, and no mention at all of women who identify as “trans men.” We must assume that the bill was designed entirely to serve the desires of incarcerated males who claim to identify as transgender, without regard for the safety and privacy of women in prison.

State Sen. Wiener claims that this law is needed because males who identify as transgender "face particular risk of rape and assault" in facilities for incarcerated males, and therefore prison policies should "take into account a person’s gender identity and their perception of safety, making them more vulnerable to violence from other incarcerated people." In other words, a man’s “perception of safety” is given more weight than the material factors that make women particularly vulnerable to male violence.

    Men do not belong in women’s prisons. Sex is binary. Mentally ill people need treatment, not transition.

    All incarcerated people deserve safety and dignity. The fact that men, women, and trans people are raped and abused while in prison is a failing of society and our prison system. Women deserve female-only spaces, even while imprisoned, as a safety precaution against those who would abuse them. Women have fought long and hard for the few safety measures we have now; please don’t strip them from us in the name of “inclusivity.”

    Incarcerated women deserve to be safe from rape and violence from people with penises. If incarcerated Trans people feel unsafe the State should make seperate facilities for them.


    If men can self identify then they will do this to leave men’s prisons to have access to vulnerable women. Most trans women continue to have penis in vagina sex. This is unfair to women as they serve out their sentences.

    Whatever solution is found for men who say they are women should always maintain facilities exclusively for biological women. Find another solution for men who say they are women.

    Learn from the UK experience! Violent male offenders who identify as women have already been placed in female prisons – and assaulted women therein. The UK is now going back to housing prisoners based on biological sex.

    “Sex” is objective & verifiable, and trumps subjective “gender identity” that is already being exploited by ‘bad actors’ masquerading as women. If Senator Wiener doesn’t care about the rights of women in prison (including female guards who, for example, would be required to strip-search males identifying as women, regardless of their anatomy), perhaps Senator Wiener and his fellow legislators will consider that SB 132 will open up a floodgate of lawsuits by women against the State for violating their rights under The Civil Rights Act of 1964. By stating “gender identity that differs from their sex assigned at birth”, SB 132 explicitly acknowledges that transwomen are male, therefore SB 132 violates women’s rights. We can support transgender rights without trampling on the rights of women in the process. Figure out a better way.

    Where has common sense gone? These are males, not women. Women can’t escape these men in prison, so this is like punishing them twice. These women are already at risk already and you want to place men who may have a history of assault in with them?


    Use your mind for once. Think and find common sense! Men do not belong with women in prison.

    Women have fought for decades to have protection from violence. Please review what happened in the UK when trans identifying men were allowed in women’s prisons. Half of those men where sex offenders and some of them abused women in the prisons. Now all trans identifying prisoners will be housed in separate prison units of the sex that was observed at their birth. Trans-identifying men will be in in their own wing in the men’s prisons and trans identifying women in the women’s prison. Why are there no provisions in this bill to screen trans identifying men to insure that no sex offenders or those with mental issues are not place with women.? Why are there no provisions to protect women prisoners? Do we not know how to learn from the experience of the UK regarding this issue? Do we have to wait until abuse of women occurs to make them safe? Please reconsider this Bill.

    Trans-identifying people require special accommodations to ensure their safety in prison, on a case by case basis, but such should not occur at the expense of women in prison who should not be housed with either gender conforming or gender nonconforming male inmates. Women’s lives matter.
